REGULATIONS OF THE PROMOTIONAL INITIATIVE "KLEAR REFERRAL"

1. Promoter

Klear Finance S.r.l. (hereinafter referred to as "Klear" or the "Company"), with its registered office at Via Mario Morgantini 25, 20148 Milan (MI), operational office at Corso di Porta Romana 61, 20122 Milan (MI), VAT number 13462040968.

2. Name of the initiative

"Klear Referral" (hereinafter referred to as the "Initiative").

4. Duration and territorial scope

— Duration: From the date of publication of these regulations until 11:59 PM on December 31, 2025.

— Territorial scope: territory of the Italian Republic (including, where applicable, San Marino and Vatican City).

5. Recipients

All registered Klear customers on the platform (hereinafter referred to as "Klear Users" or "Referrers"), who are adults and residents/domiciled in Italy, can participate. Excluded are:

— employees, collaborators, consultants, and suppliers of the Company and its associated companies;

— individuals whose account is suspended/closed;

— users who do not comply with these regulations.

6. Purpose of the Initiative

— The registered Klear User can request a discount code (the "Code") on the platform, which provides a 20% discount on the price of the plan, usable exclusively by other Klear Users for the purchase of a Core or Premium paid plan.

— It is prohibited for the same User who generated the Code to use it (self-use not allowed).

— Sharing: the Referrer can share their Code with third parties who wish to register/join Klear and subscribe to a Core or Premium plan.

— No reward or benefit is provided for mere registration without the purchase of a Core or Premium plan.

7. Participation mechanics and rewards

1) The person receiving the Code ("Invitee"), at the time of purchasing a Core or Premium plan, enters the Code (mere registration does not entitle to rewards/discounts):

   • the Invitee receives a 20% discount on the price of the Core or Premium plan.

   • the Referrer (the one who generated the Code) earns a reward in the form of an Amazon.it gift card worth €50.00 (fifty/00) (hereinafter referred to as "Voucher").

2) Reward provision: the Voucher is provided within 15 (fifteen) working days from the subscription of the plan by the Invitee and the successful completion of the relevant payment/activation.

3) Channel and delivery method: the Voucher is sent to the Referrer via email to the address associated with the Klear account, in the form of a digital code.

4) Number of rewards: for each successfully completed subscription through the Code, the Referrer is entitled to a Voucher worth €50.

5) Accumulation: unless otherwise communicated, rewards are cumulative without quantitative limits.

6) Non-convertibility: Vouchers are not convertible into cash, nor can they be replaced or refunded; the terms and conditions of Amazon in effect at the time of use apply.

8. Validity conditions

In order for the right to the reward to mature:

— the Code must be valid at the time of use and associated with the Referrer;

— the Invitee must complete the registration/activation of the Core or Premium plan, using the Code, and the relevant payment must go through successfully;

— mere registration without the purchase of a Core or Premium plan does not entitle to any reward;

— there must be no withdrawal/cancellation/refund of the plan within legal time limits (e.g., right of withdrawal within 14 days). In case of withdrawal/refund, Klear may cancel or not issue the Voucher.

9. Limitations and prohibited behaviors

— Self-use: the Referrer cannot use their own Code to purchase a plan for themselves.

— Code Transfer: Codes cannot be sold, published on paid couponing platforms, or subjected to auctions or transactions for a fee.

— Abuses and fraud: deceptive or fraudulent practices are prohibited (e.g., creation of fake accounts, false identities, simulated payments). Klear reserves the right to cancel rewards and disable accounts in case of suspected abuse, subject to internal review.

— Deceptive communications: it is not allowed to use brands, domains, pages, or ads that could suggest “official” Klear channels or exploit protected brand keywords.

10. Value of the reward and non-convertibility

— Value of the single reward: €50.00 (Amazon.it gift card).

— Non-convertibility: Vouchers are not convertible into cash nor refundable; the terms and conditions of Amazon in force apply.

11. Participation methods 

The generation and use of Codes occur exclusively through the Klear platform/app. 

12. Advertising

The Initiative is communicated through the Klear website/app, email, in-app notifications, and official social channels. 

13. Processing of personal data

Data will be processed by Klear as the data controller, in compliance with Regulation (EU) 2016/679 and national legislation, for the management of the Initiative and the issuance of rewards. Complete information and rights of the data subjects are available in the Privacy Policy on the Klear website/app. Any communication of data to partners (e.g., suppliers of Vouchers) will occur to the extent necessary for the execution of the Initiative.

15. Complaints and assistance

For information or complaints regarding the Initiative: help@klearfinance.com. For the use of Vouchers, the Amazon conditions and assistance channels apply.

16. Changes, suspensions, and force majeure

Klear may modify these Regulations (without prejudice to rights already accrued), suspend or terminate the Initiative for just cause or force majeure, notifying on the website/app. Any substantial changes will be communicated on the website/app.

17. Applicable law and competent court

The Regulations are governed by Italian law. For any dispute, the court of the place of residence or domicile of the consumer shall have exclusive jurisdiction.
